By accessing or using our website (https://www.phydoes.com) or mobile applications including Magic Dancing Tiles and Pink Piano Tiles (collectively the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, immediately discontinue use of the Services.

1. Acceptance of Terms

Your continued use of the Services constitutes:

(a) Confirmation that you have read and understood these Terms;

(b) Agreement to be bound by these Terms and all applicable laws;

2. Eligibility and Account Responsibility

You must be at least 13 years of age (or the minimum age required by your jurisdiction, whichever is higher) to use the Services. Users under the age of 18 (or local legal age of majority) must obtain consent from a legal guardian.
You warrant that all account information (including contact details) is accurate, current, and complete. Failure to maintain such information may result in account suspension or termination.
You are solely responsible for safeguarding your account password and all activities conducted under your account. Notify us immediately at [email protected] of any unauthorized access.
We reserve the right to implement age verification measures for high-risk transactions.

3. Intellectual Property

All content on the Services (text, graphics, software, audio, video, etc.) is owned by Phycan Technology CO., Ltd or its licensors and protected by global intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access this content solely for personal, non-commercial use. You may not:

Modify, reproduce, distribute, or create derivative works of any content;
Remove copyright or trademark notices;
Use content for commercial purposes without our prior written consent.

4. Privacy Policy

Your use of the Services acknowledges your acceptance of our Privacy Policy, which details how we collect, use, and share your information. If you do not agree with the Privacy Policy, stop using the Services immediately.

5. Content and Content Rights

5.1 Definitions

"Content" includes all text, graphics, images, audio, video, and other materials made available through the Services.

"User Content" refers to any content you post, upload, or otherwise provide through the Services (e.g., gameplay recordings, comments).

5.2 License to Use User Content

We claim no ownership of User Content. However, by providing User Content, you grant us a perpetual, worldwide, royalty-free license to use, modify, distribute, and publicly perform such content for the sole purpose of operating and improving the Services.

5.3 Warranties for User Content

You warrant that:

You own all rights to your User Content or have permission to grant the license above;
Your User Content does not infringe any third party’s intellectual property rights, privacy rights, or applicable laws.

6. Virtual Items and In-App Purchases

6.1 Virtual Items

Virtual goods obtained through purchase, gameplay, or redemption ("Virtual Items") are licensed, not sold, to you. You receive a limited, personal, non-transferable, revocable license to use Virtual Items solely within the applicable app for non-commercial purposes.
We reserve the right to manage, modify, or remove Virtual Items at any time without notice.
Virtual Items have no monetary value, are not redeemable for cash, and cannot be sold or traded.
Except as required by mandatory local law, all Virtual Item purchases are final and non-refundable. Unused Virtual Items will be forfeited upon account termination or deletion.

6.2 Subscriptions

Purchasing a subscription grants immediate access and recurring monthly charges. Payments for subscriptions made through third-party platforms (e.g., Apple App Store, Google Play) are governed by their respective terms.
Free trial subscriptions automatically convert to paid subscriptions unless canceled before the trial ends. Activating a paid subscription forfeits any remaining trial period.
Subscriptions renew automatically unless canceled via platform-native controls (e.g., iOS Account Settings, Google Play Subscriptions). Email requests for cancellation are not valid.
We may modify subscription fees with advance notice. Fee changes take effect at the end of the current billing cycle. Your continued use after changes take effect constitutes acceptance of the new fees.
Except as required by applicable law, paid subscription fees are non-refundable.

7. Prohibited Activities

You agree not to:

Post or transmit content that is infringing, illegal, fraudulent, defamatory, obscene, or promotes discrimination, violence, or harmful activities;
Access non-public areas of the Services, probe system vulnerabilities, or bypass security measures;
Use automated tools (e.g., spiders, robots) to access or download content without our permission;
Send unsolicited advertising, spam, or chain letters;
Impersonate others or misrepresent your affiliation with any entity;
Reverse engineer, decompile, or disassemble any software used to provide the Services;
Use the Services for commercial purposes or in any manner not permitted by these Terms.

8. Copyright Policy

We respect intellectual property rights. If you believe your copyrighted work is infringed on the Services, submit a written notice to [email protected] including:

Your physical or electronic signature;
Description of the infringed work;
Location of the infringing material on the Services;
Your contact information;
A statement that you have a good-faith belief the use is unauthorized;
A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner.

Misrepresenting infringement may result in liability for damages (including legal fees).

9. Links to Third-Party Services

The Services may contain links to third-party websites or services. We have no control over these third parties and are not responsible for their content, privacy policies, or practices. Use third-party services at your own risk.

10. Termination

We may terminate or suspend your access to the Services at our sole discretion, without notice, for any reason (including breach of these Terms). Upon termination, your right to use the Services ceases immediately, and all unused Virtual Items are forfeited.

11. Disclaimer of Warranties

The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We do not warrant that the Services will be uninterrupted, secure, error-free, or meet your requirements.

12. Limitation of Liability

To the maximum extent permitted by law, Phycan Technology CO.,Ltd shall not be liable for any indirect, incidental, special, or consequential damages (including loss of profits, data, or goodwill) arising from your use of or inability to use the Services. Our total liability shall not exceed the greater of: (a) the amount paid by you to us in the preceding 12 months; or (b) USD 100.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of China, without regard to conflict of law principles. Any disputes arising from these Terms or the Services shall be resolved through the courts of China. Before initiating legal action, please contact our support team at [email protected] to seek resolution.

14. General Terms

These Terms constitute the entire agreement between you and Phycan Technology CO., Ltd regarding the Services, superseding all prior agreements.
If any provision of these Terms is held invalid, the remaining provisions shall remain in full force.
We may modify these Terms at our sole discretion. For material changes, we will provide prior notice. Your continued use after changes take effect constitutes acceptance.
